1. Agreement

These Terms & Conditions ("Terms") govern your use of Rail Call (the "Service"), operated by Melnek Enterprises LLC ("Melnek," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 21 years old (or the legal age for horse-race wagering where you live, if higher) to use the Service. You are responsible for complying with all laws that apply to you.

3. What the Service is, and is not

Rail Call is an informational analysis tool. It uses artificial intelligence to read racing forms and odds screenshots that you provide and to generate handicapping commentary and suggested bet structures.

• We are not a sportsbook, wagering operator, or betting exchange. We do not accept, place, or facilitate wagers, and we have no affiliation with FanDuel or any racetrack.
• Analysis is generated by AI, may be inaccurate or incomplete, and is not financial, betting, or professional advice.
• Horse racing involves risk. Past results do not guarantee future outcomes. You may lose money. Bet only what you can afford to lose. If gambling is a problem, call 1-800-GAMBLER.

4. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. We may suspend or remove access at any time, with or without notice, if these Terms are violated.

5. Your Claude API key

The Service requires you to supply your own Anthropic (Claude) API key. You are solely responsible for that key, for any usage charges Anthropic bills you, and for complying with Anthropic's terms. We are not responsible for charges resulting from your use of your key.

6. Premium subscription and billing

• Rail Call offers a free plan with daily limits and an optional paid plan, Rail Call Premium, for US $9.99 per month plus any applicable taxes.
• Premium is an automatically renewing subscription. By subscribing you authorize us, through our payment processor Stripe, to charge your payment method every month on the same date until you cancel.
• Card details are collected and stored by Stripe. We never see or store your full card number.
• We may change the price with advance notice. A price change applies from your next renewal after the notice, and you may cancel before it takes effect.
• If a payment fails, we may limit Premium features until the payment succeeds.

7. Cancellation and refunds

You can cancel at any time in Settings using the Unsubscribe from Premium button (or Manage billing). Cancelling stops future charges, and Premium stays active until the end of the period you have already paid for. Payments are non-refundable, and we do not give partial refunds for unused time, except where required by applicable law. If you believe you were charged in error, contact support@infieldfly.app.

8. Responsible play and local laws

Rail Call does not take bets and is not a gambling operator. You are solely responsible for any wagers you place with third parties and for making sure wagering is legal where you are. Never bet money you cannot afford to lose. If you or someone you know has a gambling problem, call 1-800-GAMBLER (US) for free, confidential help.

9. Your content

You retain ownership of the screenshots, text, and notes you submit ("Your Content"). You grant Melnek a limited license to store, process, and transmit Your Content solely to operate the Service for you, including sending it to our AI provider for analysis. You represent that you have the right to upload Your Content and that it does not violate any law or third-party rights, including the terms of any site or service it came from.

10. Acceptable use

• Do not misuse, reverse engineer, scrape, or interfere with the Service.
• Do not attempt to access other users' data or bypass access controls.
• Do not use the Service for unlawful activity or to resell our analysis without written permission.

11. Intellectual property

The Service, including its design, software, branding, and text, is owned by Melnek Enterprises LLC and protected by intellectual property laws. See our Copyright notice for details.

12. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

13. Limitation of liability

To the maximum extent permitted by law, Melnek Enterprises LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any wagering losses, lost profits, or lost data, arising from your use of the Service. Our total liability for any claim will not exceed US $100.

14. Indemnification

You agree to indemnify and hold harmless Melnek Enterprises LLC from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or the law.

15. Termination

You may stop using the Service at any time and can permanently delete your account and data yourself in Settings using Delete account. Deleting your account immediately cancels any Premium subscription with no further charges, and payments already made are non-refundable except where required by law. Deletion cannot be undone. We may suspend or terminate access at our discretion. Sections that by nature should survive termination will survive.

16. Changes

We may update these Terms. Continued use after an update means you accept the revised Terms.

17. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Ohio.
